Top 5 Rights Every Accused Must Know

Know Your Rights as an Accused Person

Being arrested or accused of a criminal offense is one of the most stressful experiences anyone can face. However, the Indian Constitution and the Code of Criminal Procedure (CrPC) provide several fundamental rights to every accused person. Knowing these rights can significantly impact the outcome of your case.

1. Right to Know the Grounds of Arrest (Article 22(1))

Every person who is arrested has the right to be informed of the grounds of arrest as soon as possible. The police cannot detain you without explaining why you are being arrested. This right is fundamental and any violation of this can lead to the arrest being declared illegal by the court.

2. Right to Legal Representation (Article 22(1))

You have the absolute right to consult and be defended by a legal practitioner of your choice. If you cannot afford a lawyer, the state is obligated under Article 39A to provide free legal aid through the Legal Services Authority. No interrogation should proceed without your lawyer being informed.

3. Right to be Produced Before a Magistrate within 24 Hours (Article 22(2))

The police must produce the arrested person before the nearest magistrate within 24 hours of arrest, excluding the time required for travel. Detention beyond this period without judicial authorization is illegal and amounts to wrongful confinement.

4. Right Against Self-Incrimination (Article 20(3))

No person accused of an offense can be compelled to be a witness against themselves. This means the police cannot force you to make a confession or provide evidence that incriminates you. Any such confession obtained under coercion is inadmissible in court.

5. Right to Bail

For bailable offenses, bail is a right, not a privilege. Even for non-bailable offenses, the court considers factors like the severity of the offense, the evidence available, and the likelihood of the accused fleeing justice. The Supreme Court has repeatedly held that bail is the rule and jail is the exception.

What Should You Do If Arrested?

  • Stay calm and cooperate, but do not make any statements without your lawyer
  • Ask the arresting officer to show their ID and the arrest warrant
  • Contact a trusted lawyer or family member immediately
  • Do not sign any documents without reading and understanding them
  • Request medical examination if you face any physical mistreatment
