Trademark Registration Process in India

Complete Guide to Trademark Registration in India

A trademark is a visual symbol — a word, phrase, logo, design, or combination — that distinguishes your goods or services from those of others. Registering your trademark under the Trade Marks Act, 1999 provides legal protection and exclusive rights to use the mark across India.

Why Register a Trademark?

  • Legal ownership and exclusive rights to the mark
  • Right to sue for infringement and passing off
  • Deterrent against unauthorized use
  • Building brand value and goodwill
  • Ability to license or franchise the mark

Registration Process

  1. Trademark Search: Conduct a comprehensive search in the Trademark Registry database to ensure your proposed mark does not conflict with existing registrations.
  2. Application Filing: File the application (Form TM-A) online through the IP India portal with the prescribed fee.
  3. Examination: The Trademark Examiner reviews the application and may raise objections. An examination report is issued within 30 days.
  4. Response to Objections: If objections are raised, you must respond within 30 days and may need to attend a hearing.
  5. Publication in Journal: If accepted, the mark is published in the Trademark Journal for 4 months to allow third-party opposition.
  6. Registration Certificate: If no opposition is filed, or opposition is decided in your favor, the registration certificate is issued.

Timeline and Costs

The entire process typically takes 8-12 months if there are no objections or opposition. The registration is valid for 10 years and can be renewed indefinitely.
